Brandon Cristopher Lopez Tay, 24, of Waldorf, is facing multiple charges including malicious destruction of property under $1,000, driving under the influence of alcohol, driving while impaired by alcohol, and violating a license restriction following an early morning incident in Charles County, according to court documents.
According to charging documents, the incident occurred on April 17, 2026, at Lucky’s Bar and Grille in Waldorf. Officers responded around 1:10 a.m. for a reported destruction of property. Dispatch advised that “the suspect damaged the front door of the business and was in gray pick up truck,” according to the statement of probable cause.
When officers arrived, they located a gray Ford pickup truck parked in front of the business and running. A witness, identified as the owner of the establishment, told officers “that the driver in the gray ford truck was the suspect.”
Investigators made contact with Lopez Tay, who was seated in the driver’s seat. Witnesses reported that he had been removed from the business for fighting. According to statements, “while being kicked out, Lopez Tay went in to the bathroom and ripped paper towel holder off of the wall causing damage,” and “while exiting the bar, Lopez Tay then kicked the front door, causing significant damage to the door.”
Authorities said Lopez Tay left the scene in his truck but returned prior to police arrival. During the investigation, officers observed signs of impairment. Court records state he “smelled heavily of an alcoholic beverage and had red, watery eyes,” and was “swaying side to side” while speaking with officers.
Field sobriety tests were conducted with the assistance of an interpreter. Officers noted multiple indicators of impairment, including “6/6 clues of impairment” during the horizontal gaze nystagmus test, “7/8 clues of impairment” during the walk-and-turn test, and “3/4 clues of impairment” during the one-leg stand test.
Based on these observations, an officer concluded that Lopez Tay “was impaired and unable to operate a motor vehicle safely.” He was placed under arrest and transported to the Charles County Detention Center.
Court records show Lopez Tay was released on personal recognizance by District Court Commissioner Talia Thomas, with conditions that he “not engage in any criminal conduct” and “appear in court when notified to do so.”
