Benjamin James Gill, 41, of Dameron, has been charged in St. Mary’s County District Court with possession of a controlled dangerous substance that was not cannabis after a May 21, 2026 traffic stop in Lexington Park, according to court documents. The charge is listed as a misdemeanor under Maryland criminal law, with the statement of charges identifying the substance as suspected cocaine.
The case, filed as State of Maryland v. Benjamin J. Gill, was opened May 21, 2026, in District Court for St. Mary’s County. Court records list the case as an on-view arrest and show the charge as “CDS: possess-not cannabis.” The filing lists Deputy Travis Wimberly of the St. Mary’s County Sheriff’s Office as the arresting and complainant officer.
According to the statement of probable cause, Deputy Wimberly wrote that he was driving a marked patrol vehicle near Pegg Road and Three Notch Road in Lexington Park on May 21, 2026, when he saw a 2003 gold Hyundai Sonata stop past the white stop pavement marking before turning right onto Three Notch Road. The deputy reported initiating a traffic stop, and the vehicle pulled into a location on Three Notch Road in Lexington Park.
Court documents state that when the deputy approached the front passenger window, he saw “a rounded piece of copper brillo containing a burnt residue” on the front passenger floorboard, which he suspected was connected to crack cocaine use. The deputy wrote that the item was found directly beneath where Gill had been seated.
The statement says the driver, Gill, and a rear-seat passenger were ordered out of the vehicle while deputies conducted a search. During a search of Gill, the deputy reported finding a clear tied-off baggie containing a folded index card with a white powder substance suspected to be cocaine, concealed inside Gill’s rubber shoe, described in the document as a Croc.
The charging document formally alleges that Gill possessed a Schedule II controlled dangerous substance, “to wit: cocaine,” on or about May 21, 2026, at a location on Three Notch Road in Lexington Park. Probable cause was marked as found in the court paperwork.
